IMPLEMENTING RULES AND REGULATIONS OF REPUBLIC ACT NO. 8534
Pursuant to Section 8 (a) and Section 10 of Republic Act No. 8534, otherwise known as the "Philippine Interior Design Act of 1998," the Board of Interior Design hereby promulgates, adopts, prescribes, and issues the following Rules and Regulations to carry out the provisions of the said law.
Article I
TITLE AND DEFINITION OF TERMS
Rule 1. Title
This resolution shall be known as the Rules and Regulations Implementing the Philippine Interior Design Act of 1998.
Rule 2. Definition of Terms
Unless otherwise provided the following shall be understood to mean:
a. Commission: shall refer to the Professional Regulation Commission (PRC).
b. Commissioner: shall refer to the Chairman of the Professional Regulation Commission.
c. Board: shall refer to the Board of Interior Design under the Administrative supervision of the Professional Regulation Commission
d. Chairman: shall refer to the Chairman of the Board of Interior Design.
e. CHED: shall refer to the Commission on Higher Education.
f. CPE: shall refer to the Continuing Professional Education.
g. NBI: shall refer to the National Bureau of Investigation.
h. Interior Design: shall refer to the functional, orderly and aesthetic arrangement and development of the interior of buildings and residences that shall contribute to the enhancement and safeguard of life, health, property and the promotion and enrichment of the quality of life of their occupants.
Article II
BOARD OF INTERIOR DESIGN
Rule 3. Filing of Application for Membership of the Board
An applicant for membership in the Board shall file his application in a form prescribed by the Commission together with the hereunder documents, to wit:
a. Birth Certificate
b. Barangay Certificate of Residency for the past two years
c. Certificate of member of good standing and professional conduct from the accredited and integrated association of interior designers
d. Transcript of Records with a Bachelor's degree or course, date of graduation and Special Order Number unless exempt therefrom due to accreditation of a course by DECS or to being a state school/college graduate; Provided graduates of equivalent Interior Design courses prior to the establishment of the Bachelor of Interior Design curriculum are qualified
e. Certificate of registration and professional license
f. Certificate of at least ten (10) years interior design practice from accredited and integrated association of Interior Designers
g. Affidavit of non-membership of faculty of any school where a regular course of Interior Design is being taught nor have any pecuniary interest in or administrative supervision over any such institution of learning and not connect with a review centre or lectures in preparation for licensure examination; and
h. NBI Clearance of non-conviction of crimes involving moral turpitude
Rule 4. Enforcement and Execution
The Board in the administration of Republic Act 8534, shall rely on the enforcement, assistance and support of the Commissioner through the latter's offices, divisions, sections and units.
Rule 5. Promulgation of Decisions, Orders, Resolutions and Other Issuances
The Board shall meet en banc and vote personally in the promulgation of a decision, resolution or order in an administrative case or a policy, rule, regulation, measure, directive, order, circular or resolution on the implementation of Republic Act No. 8534. Both a quorum and a majority vote are prerequisites for the validity of any of the foregoing actions. Said quorum and majority vote shall consist of not less than two (2) members of the Board.
Any official action of the Board other than a decision, resolution or order issued in an administrative case shall be valid, enforceable and effective only after it shall have been reviewed by the Commission and published in the Official Gazette or a newspaper or general circulation. Publication shall not be required for actions that are internal, administrative and not affecting the public and not penal or disciplinary in nature.
Rule 6. Official Business with the Commission
For any transaction or business with the Commissioner, the Chairman of the Board shall be the official representative of the Board. However, in case of his indisposition, he may authorize any of the Board members or the Secretary of the Regulatory Board to represent him.
Rule 7. Assignment of Duties
The Chairman shall be responsible for the assignment of duties and responsibilities to the members and for the supervision and management of their work.
Rule 8. Action on Papers, Communications or Other Documents
All papers, communications, certificates, decisions or other documents shall be solely and exclusively acted upon by the Board within the premises of the Commission.
Rule 9. Opinions on and Interpretation of Republic Act 8534 and the Board's Rules and Regulations
The Board, in the discharge of its quasi-legislative power, may issue an opinion on, construction or interpretation of, any provision of R.A. 8534; the Board's Rules and Regulations; Code of Ethics; policies, issuances, etc. The issuances of the Board's official action shall be released through the Chairman or, if he so authorizes, through any of the Board members of the Secretary of the Regulatory Boards.
Rule 10. Continuing Professional Education
The Board, pursuant to Section 8 (j) of R.A. 8534, shall prescribe guidelines for the Continuing Professional Education (CPE) program in coordination with the accredited and integrated association of Interior Designers. As such, the Board shall create a CPE council to implement and oversee the CPE program.
Rule 11. Place and Date of Examination
The licensure examination shall be given at least once a year in Metro Manila. The Board shall recommend to the Commission for approval the schedule and venue of the licensure examination for interior designers.
Rule 12. Program of Examination
The Board shall issue a program for every schedule and venue of the licensure examination, indicating therein the subjects with their dates, time and percentage weights and the instructions, not later than twenty (20) days prior to the first day of the examination.
Rule 13. Publication of Examination
The dates and venues of the licensure examination shall be published in a newspaper of general circulation and/or disseminated through schools, colleges and universities offering the course and through the accredited and integrated Interior Design association at least a month prior to the first day of the examination.
Rule 14. Qualification for Examination
An applicant for the interior design examination shall have the following qualifications
a) He must be a citizen of the Philippines
b) He must have graduated with a degree of Bachelor of Interior Design or Master of Interior Design from a school, academy, institute or college duly recognized by the CHED; Provided: That graduated of equivalent Interior Design courses prior to the establishment of the Bachelor of Interior Design curriculum are qualified; and
c) He must not have been convicted of any crime involving moral turpitude.
Rule 15. Filing of Application for Examination
An applicant for examination shall file his application in a form prescribed by the Commission at least ten (10) days prior to the examination, together with the following documents:
a) Proof of Philippine Citizenship, e.g. Certificate of Naturalization, Voter's Affidavit or Voter's ID Card;
b) Certificate of Live Birth and/or Marriage Contract (if applicant is a married female)
c) Transcript of Records, with the name of the degree or course, the date of graduation and Special Order Number, unless exempt therefrom due to accreditation of a course by DECS or to being a state school/college graduate
d) NBI Clearance attesting that the applicant has never been convicted of any crime involving moral turpitude.
Approval or denial of application shall require the mutual action of at least two board members. No application shall be approved unless all the qualifications shall have been established through the above mentioned documents.
Article IV
REGISTRATION WITHOUT EXAMINATION
Rule 16 Automatic Registration
All interior designers registered under the Specialty Board of Interior Design at the time Republic Act 8534 took effect, shall be automatically registered.
Rule 17 Filing of Registration Without Examination
An applicant for registration without examination shall file his application in a form prescribed by the Commission together with the hereunder documents, to wit:
a) Proof of Philippine Citizenship, e.g. Certificate of Naturalization, Voter's Affidavit or Voter's ID card;
b) Certificate of Live Birth and/or Marriage Contract (if applicant is a married female);
c) Transcript of Records, with the name of degree/course, date of graduation and Special Order Number, unless exempt therefrom due to accreditation of course by the Department of Education, Culture and Sports (DECS) or to being a state school/official graduate;
d) Certificate of interior-design practice.
Rule 18. Qualifications for Registration Without Examination
An Applicant for registration without the recourse of passing the licensure examination must have any of the following academic and/or training background or experience:
a) Interior designer practitioners who had taken at least sixty (60) units of interior design for ten (10) years prior to effectivity of Republic Act 8534, and who can show proof of practice; and
b) Registered and duly licensed architects who had been practising interior design for ten (10) years prior to the effectivity of Republic Act 8534, and who can show proof of practice.
Article V
ISSUANCE AND CERTIFICATE OF REGISTRATION AND PROFESSIONAL LICENSE
Rule 19. Registration and Issuance of Certificate of Registration and Professional License
Upon completion with all the legal requirements for registration, a registrant shall be allowed to enroll his name and other essential data in the Roster of Registered Interior Designers and shall be issued a Certificate of Registration and Professional License.
Rule 20. Taking the Oath of a Professional
All applicants for registration as interior designers shall be allowed to take their oaths as such only after they shall have registered.
Rule 21. Renewal of Professional License
The Professional License shall be renewed once every three years, on the birth-month of the interior designer, upon compliance with the payment of the annual license and registration fees for three years.
Rule 22. Registration Number and Expiry Date of the Professional License
A registered interior designer shall indicate in all documents he issues, signs and uses in the practice of his profession his Certificate of Registration number, together with the date of issuance and the expiry date of his professional license.
Article VI
APPLICATION FOR TEMPORAL/SPECIAL PERMIT
Rule 23. Filing of Application for Temporary/Special Permit to Practice Interior Design
A foreigner wishing to avail of a Temporary/Special Permit to practice Interior Design profession in the Philippines shall file his application on a project-to-project basis, in a form prescribed by the Commission together with the hereunder documents, to wit:
a) Proof of Citizenships, e.g. passport;
b) Proof of Reciprocity, e.g. law allowing Filipino Interior Designers to practice interior design on the same basis as national of the country where said applicant is a citizen;
c) Applicants registration and license;
d) Certificate of necessity to practice or advantageous to Philippines particularly in the aspect of technology transfer and specialization from accredited and integrated association of Interior Designers in the Philippines;
e) Contract of Filipino counterpart specifying among others:
1. sharing of liabilities and taxes due Philippine government;
2. participation in and sharing of professional services to be rendered;
3. sharing of professional fees.
Article VII
REPORT ON THE PERFORMANCE OF THE CANDIDATES OF SCHOOLS, COLLEGES AND UNIVERSITIES IN LICENSURE EXAMINATIONS
Rule 24: Report of the Board
The Board shall with the assistance of the Public Information and Statistics Section of the Professional Regulation Commission, prepare a report on the performance of the candidates of schools, colleges or universities in the licensure examinations. The Board may recommend to the Commission on Higher Education:
1) the monitoring of the schools, colleges and universities, whether public or private, whose candidates who passed in the licensure examinations are less than 5% of the total number of candidates who took the said licensure examinations;
2) the publication of the names of schools, colleges and universities whose candidates who passed in the licensure examinations are less than 5% of the total number of candidates who took the said licensure examinations in at least five (5) consecutive/successive licensure examinations; and
3) closure of the same.
Article VIII
MISCELLANEOUS PROVISIONS
Rule 25. Administrative Investigation
The conduct and procedure of an investigation initiated by the Board against an examinee or a registered interior designer shall by governed by the provisions set forth in Articles IV, V and VI of the "Rules and Regulations Governing the Regulations and Practice of Professionals" and/or any other rules that may be issued by the Commission Board, or the President of the Republic of the Philippines. The Rules of Court shall be suppletory to the foregoing rules.
Rule 26. Grounds for Disciplinary Action.
The Board, in meting out a penalty of revocation of license, suspension from the practice of profession or reprimand to an examinee or registered interior designer-respondent, may invoke the following causes:
1) Violation of any provision of R.A. 8534;
2) Violation of any of the Rules and Regulations of the Board or any policy or administrative issuances;
3) Breach of Code of Professional Ethics for Interior Designers
Rule 27. Enforceability of the Board's Decision
The decision of the Board imposing a disciplinary action against the respondent in an administrative case shall become final and executory unless it is appealed by the respondent to the Commission within fifteen (15) days from the receipt of the decision. The Board's or Commission's decision is appealable to the Court of Appeals, in accordance with the procedure provided under the Rules of Court.
Rule 28. Applicability of the "Rules and Regulations Governing the Regulation and Practice of Professionals"
In the enforcement, implementation and administration of the provisions of R.A. 8534 and the herein "Rules and Regulations of the Board of Interior Design", the Rules and Regulations Governing the Regulation and Practice of Professonals shall be suppletorily appplicable.
Rule 26. Examination, Registration, License Fees and Fines.
The Accounting Division of PRC, out of the ten percent (10%) collected examination fees from the examinees, shall provide and keep a separate book of account for a trust fund that will defray the establishment and maintenance of a center for continuing education and research; and out of the fifty percent (50%) collected as registration and license fees, and fines, shall provide and keep a separate book of account for a special fund for the supervisory and regulatory functions of the Board.

Rule 29. Separability Clause
If, for any reason, any section or provision of the herein "Rules and Regulations" or the application of such rules and regulations or provisions to any person or circumstance is declared unconstitutional, unlawful or invalid, no other section or provision of this "Rules and Regulations" shall be affected thereby.
Rule 30. Effectivity Clause
The herein "Rules and Regulations" shall be, upon the approval by the Commission, be effective after fifteen (15) days following its full publication in the Official Gazette or any newspapers of general circulation, whichever is earlier.

Rule 29. Separability Clause
If, for any reason, any section or provision of the herein "Rules and Regulations" or the application of such rules and regulations or provisions to any person or circumstance is declared unconstitutional, unlawful or invalid, no other section or provision of this "Rules and Regulations" shall be affected thereby.
Rule 30. Effectivity Clause
The herein "Rules and Regulations" shall be, upon the approval by the Commission, be effective after fifteen (15) days following its full publication in the Official Gazette or any newspapers of general circulation, whichever is earlier.
